1. General Provisions
1.1. These Regulations are an integral part of the agreement.
2. Conditions for participation in ConExPest
2.1. An exhibitor may be a legal or natural person, who presents an offer in accordance with the thematic scope of the Trade Fair, approved by the Polish Association of Disinfection and Pest Control Professionals (hereinafter called PADPCP or organizer).
2.2. An agreement of participation in ConExPest is drawn up between PADPCP and an Exhibitor after signing and submission of the participation form/s by the Exhibitor by post, e-mail or fax, prepared by PADPCP, paying the rent of the exhibition space in accordance with the invoice received from PADPCP and confirmation of participation by PADPCP by post, fax or e-mail. The Exhibitor shall, depending on the form of the business, provide a current copy from KRS (National Court Register) or the appropriate document from the Register of Business Activity.
2.3. The same procedure applies to contracts for other services provided by PADPCP or manager of the exhibition space.
2.4. The exhibitor may lose the right to participate in ConExPest if:
a) failure to pay the charge for participation by the date specified by the exhibition organizer;
b) non-compliance with the regulations.
If PADPCP exercises this right, a statement of termination of the agreement without notice is filed with the Exhibitor, and PADPCP is entitled to require the Exhibitor to pay any charges for participation in ConExPest, or compensation.
2.5. PADPCP may refuse to confirm the application for participation without providing a reason. In such a case, PADPCP shall notify the applicant in writing within 15 days of the day of receipt of the application.
2.6. In the case of a refusal to confirm the application by PADPCP, the Exhibitor is entitled to reimbursement of all paid charges. The Exhibitor is not entitled to any other form of compensation.
2.7. In the case the Exhibitor does not settle all payments for participation in the Trade Fair organized by PADPCP before the end of the event, PADPCP reserves the right to retain the exhibits and other movable property located in the exhibitor's stand and establishing a lien until all amounts due are paid by the Exhibitor. The Exhibitor waives any claims with regard to carrying out the above by PADPCP.
3. Payment terms and conditions
3.1. The charges for participation in ConExPest 2011 are determined by PADPCP. These charges include the fee for space rental and a fee for additional orders made on the forms (participation and additional) and relate to the period of preparation, duration and closing of the events.
3.2. After drawing up the agreement (paragraph 2.2), the charges must be paid in full, and the documents submitted to PADPCP must be accompanied by a copy of proof of payment.
3.3. The condition for receiving a stand is to document the completion of all payments or settlement of all due payments.
4. Resignation and withdrawal from participation in ConExPest
4.1. In the case of a written notification of resignation from participation in the Trade Fair more than 30 days before the start date of ConExPest, the fees paid for the space rental are refundable, less any bank charges associated with these operations. Refunds will be made within 30 days from the closing date of ConExPest.
4.2. In the case of a resignation from participation in ConExPest less than 30 days before the Trade Fair, the applicant is not entitled to reimbursement. PADPCP has the right to claim the full amount due for participation in ConExPest, as long as they were previously regulated.
4.3. If the Exhibitor does not participate or resigns from participation in ConExPest in the manner specified in paragraph. 4.2., the Exhibitor is obliged to pay the full amount resulting from the orders places and all documented expenses incurred by PADPCP in connection with the application, and then withdraw from participation or not exhibit at the stand.
4.4. The Exhibitor shall file a resignation from ConExPest in writing under pain of nullity and send it to PADPCP by e-mail, certified letter or deliver in person at the PADPCP office. The qualification of a resignation resulting from paragraph 4.1 or 4.2 depends on the email send date, the postmark date or the date of submitting the form to the PADPCP office.
5. Design and assembly of exhibition space/ stand.
5.1. If the Exhibitor orders assembly of the exhibition area, the organizer shall provide a standard stand in the octagonal system with the equipment described in the ConExPest 2011 participation form.
5.2. Any changes in the equipment of the stand and ordered media made by the Exhibitor less than 21 days before ConExPest will be implemented as possible and require an additional charge. The Exhibitor waives any potential claims in a situation in which the organizer cannot achieve the requested changes.
5.3. If the Exhibitor orders an empty space and subcontracts the construction of the stand to a firm other than the one indicated by the event organizer, the Exhibitor is required to read the general rules for "stand" companies, submit the name of the company constructing the stand, submit the stand design and simplified wiring diagram for PADPCP approval at least 30 days before the Fair. In the event of lack of approval, the organizer cannot allow the stand constructing company onto the Fair area.
5.3.1. In the case described in paragraph 5.3, the Exhibitor will be charged an additional handling fee, as indicated in the participation form, for commencing with stand construction work at an earlier date than the official assembly days of the particular Fair.
5.3.2. The Exhibitor is required after completion of stand assembly and disassembly to remove any remains (cardboard, foils, boards, etc.). In the case the area is left disordered, the organizer and manager of the exhibition space will commission clean-up work at the Exhibitors expense.
5.3.3. The Exhibitor is responsible for the actions of its stand constructor as for its own, including compliance with the provisions of the organizer and manager of the exhibition space, fire and occupational safety regulations in force at ConExPest and for damages caused to the organizer, manager of the exhibition space, or other participants. In the case of violations in this regard, the organizer is entitled to request termination of these violations, and if they are not abandoned - to terminate the contract without notice.
5.4. PADPCP reserves the right to change the assigned location of the stand, which results from the exhibition space design for a particular event.
5.5. Placing displays or advertising materials on the walls of the stand using a technique that causes their permanent damage is prohibited.
5.6. The exhibitor is financially responsible for damage to the stand and equipment. In the case of damage, the owner of the stand or PADPCP shall charge the Exhibitor additional fees.
5.7. Repair of damage or change in the design of the stand during ConExPest can only be done during the hours the exhibition is closed to visitors.
5.8. The Organizer reserves the exclusive right to the use of the exterior stand walls.
5.9. The electrical, plumbing and Internet access connections can only be carried out by persons authorized by the organizer and manager of the exhibition space after an earlier order in accordance with the application forms.
5.10. All electrical and plumbing installations as well as those using compressed air can only be started after their receipt and release for use by the designated by the organizer or manager of the exhibition space authorized employee.
5.11. Any failures in the delivery of utilities must be reported immediately to the organizer of the Trade Fair. The organizer and the manager of the exhibition space will not be liable for damage caused by such failures. If the failure is not immediately reported, the organizer is entitled to charge the Exhibitor the costs of its removal.
6. Co-exhibitors
6.1. A co-exhibitor is a company not renting an autonomous area, but physically present at an Exhibitor's stand and presenting its products.
6.2. The Exhibitor is required to notify of co-exhibitors and obtain PADPCP consent for their participation in the Trade Fair.
6.3. The co-exhibitor is obliged to comply with the Regulations of ConExPest, and the exhibitor is responsible for its actions as for its own.
6.4. The co-exhibitor has the rights of the Exhibitor, provided that all payments were paid by the Exhibitor.
6.5. The Exhibitor is not entitled to further sublease or transfer the stand in any form to other entities other than those filled in the application as sublease exhibitors.
7. Displays
7.1. The Exhibitor is required to label their displays.
7.2. The displays cannot be placed in passageways, and equipment demonstrations cannot hinder or prevent the safe movement of participants and the audience or violate the peace. It is prohibited to suspend displays or any other piece of stand equipment from the structure of the exhibition hall.
7.3. The Organizer reserves the right to refuse permission for the installation of displays which he considers dangerous or arduous as well as displays not reported on the displays card but requiring certain conditions met, without incurring any liability on this account.
7.4. Displays that require special protection or need to meet special technical conditions can only be put up after obtaining written permission of the PADPCP and the manager of the exhibition space.
7.5. If the displays require certain conditions to be provided, the Exhibitor is obliged to obtain written confirmation of the possibility of their fulfillment.
7.6. The displays must comply with fire safety standards, and must be marked in accordance with the requirements of the National Labour Inspectorate, etc.
7.7. The Exhibitor is solely responsible for displays, in particular for damage caused by them, their adequate protection (including when they remain on the exhibition premises after close) and that they meet all required regulations and standards, have the necessary certificates and approvals.
8. Shipping
8.1. Import/export of goods by Trade Fair participants from countries outside the EU means bringing in/out goods into the customs territory of the European Community and causes obligations under the customs laws, unless international agreements provide otherwise. Trade Fair participants from a non-European Community country should review the existing Community legislation (Community Customs Code, Common Customs Tariff) and the internal laws of the Republic of Poland (Act on Customs Law and regulations).
8.2. In the event that either the Organizer or the manager of the exhibition space are indicated as the recipient of the displays, the Exhibitor waives all claims against the organizer and manager of the exhibition space for their damage, improper handling or storage.
8.3. The Exhibitor is obliged to make any necessary customs clearance to allow the presentation of the display at the Trade Fair at their own expense and responsibility.
8.4. The need for use of cranes, forklifts, etc. should be reported to PADPCP and the manager of the exhibition space 80 days before the event. Displays of large size or weight that require to be placed prior to the construction of the stand must be reported to PADPCP and the manager of the exhibition space prior to assigning the stand location. PADPCP and the manager of the exhibition space reserve the right to change the location of the stand due to the technical parameters of the displays.
9. Catalog, advertising, concurrent events
9.1. Each exhibitor may submit an entry into the event catalog. 9.2. PADPCP is not responsible for editorial errors or omissions in the catalog.
9.3. During the exhibition, presentations, advertising activities or entertainment shows may be held with the prior consent of PADPCP and the manager of the exhibition space. These undertakings cannot interfere in any way with the other Exhibitors or disturb the general order of the Trade Fair.
9.4. Photographing and filming others' displays is prohibited without the consent of the concerned parties.
9.5. PADPCP and the manager of the exhibition space reserve the right to film and photograph the stands and to use these materials for their own purposes without any liability to Exhibitors or any third party.
9.6. The maximum individual sound level cannot be higher than 75 Db. It is forbidden to target speakers in the direction of the adjacent stands.
9.7. In the case of playing of music or other audio-visual materials, the Exhibitor is obliged to settle any claims related to public performance and other laws, according to the Law on Copyrights and Related Rights.
9.8. The manager of the exhibition space and PADPCP are not responsible for the infringement of the rights of Trade Fair participants, resulting from legal protection of inventions, industrial design, copyrights etc.
9.9. Any advertising outside the stand may only take place in the forms agreed upon with the organizer of ConExPest and after payment of a suitable fee. Advertisement placed without the consent of the organizer will be removed at the cost and responsibility of the Exhibitor.
10. Trade Fair Organization and regulations
10.1. The Exhibitor is obliged to comply with building and fire regulations in force at ConExPest and to comply with specific provisions in force in their business and to show - at the request of the organizer and the manager of the exhibition space - the appropriate permits, if such exist under the requirements of the law.
10.2. The Exhibitor is obliged to allow access of the fire commission to any premises in his stand, in order to check for fire safety.
10.3. The Exhibitor is obliged to occupy his stand, organize and leave at the time intended by PADPCP and the manager of the exhibition space for the preparation of the exhibition (by the end of the assembly day)
10.4. In situations motivated by random events. With the consent of the organizer, upon payment of charges for each hour of extension of the assembly day and after paying for individual protection of the stand during this time, assembly may be extended.
10.5. During ConExPest, the Exhibitor and its representatives are required to wear the IDs received from PADPCP.
10.6. The Exhibitor is not authorized to bring onto the premises of the Fair persons who are not employees without the consent of the organizer.
10.7. During the opening hours of the event, the stands should be available to the public. Temporary closing of the stand requires the consent of the Organizer.
10.8. During the event, it is allowed to remain at the exhibition space no longer than one hour beyond the period provided for viewing.
10.9. The Exhibitor is obliged to remove empty containers from the stand and the site before the start of the event.
10.10. Stand cleaning - if it is outsourced to the organizer or the manager of the exhibition space - should not interfere with the opening hours of the exhibition.
10.11. Devices connected at the Exhibitor's stand shall exceed the electric power ordered by him. In the case of non-compliance, the Exhibitor will be charged with any costs associated with repairing damage to the power supply and the payment of compensation.
11. Safety - insurance
11.1. PADPCP and the manager of the exhibition space have no liability for personal accidents or damage to the displays held at the Trade Fair space before, after and during the event.
11.2. PADPCP and the manager of the exhibition space are not responsible for vehicles or other movable property left on the grounds of the Trade Fair.
11.3. PADPCP and the manager of the exhibition space are not liable for damage caused by theft and burglary to the exhibition premises or storage places, for damage caused through the fault of the Exhibitor, shortage of supply of power or water, and for damage caused by force majeure such as strikes, riots, fire, lightning, hurricane, flood, hail, rain. This also applies to the period after the event, if the displays, equipment housing and other goods remain at the space.
11.4. The exclusion of liability is not subject to any restrictions in spite of PADPCP's and the manager's of the exhibition space undertaking of specific protection measures.
11.5. The Exhibitor is obliged to insure against civil liability arising from participation in this exhibition event, as well as insure the displays. The certificate of insurance must be presented on the request of PADPCP and the manager of the exhibition space.
11.6. Weapons, explosives and items whose use may endanger the safety of persons present at the Trade Fair are forbidden.
12. Securing the site
12.1. The Trade Fare site is protected by professionals hired by the organizer or the manager of the exhibition space.
12.2. During the opening hours, the Exhibitor is obliged to protect at their own expense the displays, facilities and equipment against possible damage, and before closing secure the exhibition in a manner that prevents damage.
13. Closedown
13.1. Disassembly of the exhibition and removal of displays before the official closure of ConExPest is prohibited.
13.2. The Exhibitor is obliged to remove the exhibition, remove the displays and restore the occupied exhibition area to its original state, no later than the date indicated by PADPCP and the manager of the exhibition space. If a disordered area is left behind, the organizer or the manager of the exhibition space will commission works at the cost of the Exhibitor.
13.3. Leaving the stand and the Fair by the Exhibitor is only possible after the presentation of the relevant document of turning in the stand. The document of turning in the stand must be signed by the organizer or the manager of the exhibition space.
13.4. In the case of not vacating the exhibition space within the period specified by the PADPCP and the manager of the exhibition space, the organizer and the manager of the exhibition space are entitled to the right to move to another place the goods and displays left behind at the cost and risk of the Exhibitor, even if it does not reflect the requirements necessary for the properties of the displays.
13.5. Pieces of the exhibition and other equipment left without the approval of the organizer and the manager of the exhibition space during the liquidation shall be deemed abandoned property that passes without compensation to the property of the organizer or the manager the of exhibition space.
14. Complaints and claims
14.1. All complaints and claims arising from participation in the Trade Fair must be submitted in writing no later than the last day of the Fair. No complaints or claims will be considered after this period.
14.2. Any agreement between the Exhibitors and PADPCP or the manager of the exhibition space and any decisions arising from them as well as statements must be in writing under pain of nullity.
15. Final Provisions
15.1. The Exhibitors participating in ConExPest organized by PADPCP are obligated to comply with the applicable regulations and comply with the herein regulations, supplementary rules and regulations of the various events as well as regulations in force at the facility, where ConExPest takes place. The Exhibitors not complying with these terms and conditions are liable for any damages incurred by PADPCP and the manager of the exhibition space or third parties.
15.2. In the case of circumstances beyond control, PADPCP or the manager of the exhibition space reserve the right to cancel, shorten, postpone or partially close the event.
15.3. In the cases referred to in paragraph 15.2. with the exception of event cancellation due to the fault of PADPCP, the Exhibitor is not entitled to any compensation or reduction of fees for participation in this event.
15.4. In the case of event cancellation due to the fault of PADPCP, the Exhibitors are entitled to reimbursement of sums paid without interest.
15.5. Any disputes that may arise from participation in ConExPest organized by PADPCP and work, supplies and services contracted out to the organizer or the manager of the exhibition space by Exhibitors shall be subjected to the jurisdiction of the Court, PADPCP or the manager of the exhibition space.
15.6. Acceptance of the conditions of these regulations takes place upon submission by the Exhibitor to participate in ConExPest.
15.7. Targi w Krakowie reserves the possibility of additional regulation provisions and other changes in the relevant annex to the contract with the Exhibitor.
15.8. These regulations take effect on 1st September 2010. |
